Terms of Service

1. Acceptance of These Terms

These Terms of Service ("Terms") govern your access to and use of the Seedance3 website, AI image and video generation tools, credits, subscriptions, and related services (collectively, the "Service").

By creating an account, purchasing credits or a subscription, completing checkout, or otherwise using the Service, you confirm that you are at least 18 years old, have read and agree to these Terms and our Privacy Policy, and have authority to bind any organisation on whose behalf you use the Service. If you do not agree, do not use the Service.

2. The Service and Third-Party AI

Seedance3 is an internet-delivered digital software service that lets users create images and videos from prompts, reference images, and other content they choose to submit. Features, supported models, output settings, generation times, and credit costs may change as the Service evolves.

Some functionality depends on third-party AI models and infrastructure. Their availability, behaviour, and outputs may vary or be interrupted. We may add, change, limit, suspend, or remove models or features when reasonably necessary to operate, improve, secure, or comply with law in relation to the Service.

Access to paid digital services and credits is made available after payment is confirmed. The refund rules in section 7 apply to this immediate digital delivery.

3. Accounts and Security

You must provide accurate and complete account and billing information, keep your login credentials confidential, and remain responsible for activity under your account. Do not share your account credentials. Notify us promptly at support@seedance3.lol if you suspect unauthorised use. If you use the Service for an organisation, you represent that you are authorised to accept these Terms for it.

4. Plans, Credits, and Credit Use

4.1 V3 Hybrid Billing Model

We offer recurring subscription plans and separate one-time credit packages. Current plan, package, feature, price, currency, and checkout details are shown on the pricing and checkout pages at the time of purchase.

• Subscriptions. Plus, Pro, and Max plans are available in monthly and annual billing intervals. Each plan includes a monthly allocation of credits: Plus 1,000 credits, Pro 3,000 credits, Max 5,000 credits, and Ultra 11,000 credits. Annual-plan subscribers receive credits monthly; they do not receive a full year's allocation at once.
• Subscription credits. Each monthly allocation expires 30 days after it is issued and does not roll over to a later allocation or billing period.
• Credit packages. Separately purchased credit packages are one-time purchases and expire 12 months after issuance. An active subscriber receives an additional 20% of the package's base credits when purchasing a package.
• Registration credit. A newly registered user may receive promotional credits, which expire seven days after issuance. Promotional credits are not cash, have no monetary value, and are not transferable.

We may change plans, prices, available packages, or future credit allocations prospectively. A change will not reduce credits already issued. Material changes to a recurring subscription will be notified as required by applicable law and, where required, before the changed price is charged.

4.2 Credit Consumption and Failed Tasks

The credit cost for a generation depends on the selected model and settings and is displayed before you submit the task. Credits are deducted from available, unexpired credit grants in order of the earliest expiration date, then issuance order where needed. You must have sufficient available credits to submit a paid-generation task.

If an eligible generation task fails under the applicable product flow, we may return the credits associated with that failed task. A returned credit is a credit adjustment, not a cash refund, and does not extend the applicable refund window unless required by law.

Credits are a limited right to use the Service, not stored monetary value, property, or a bank account. Except as required by law or expressly stated in these Terms, credits cannot be sold, transferred, exchanged, or redeemed for cash.

5. Billing, Payment, and Taxes

5.1 Subscription Renewal Authorisation

When you subscribe to a paid plan and provide a payment method, you expressly authorise us and our payment processor, Waffo Pancake, to charge the applicable subscription price and applicable taxes to that payment method at the selected monthly or annual interval. Your subscription automatically renews unless you cancel it before the end of the then-current billing period.

5.2 One-Time Credit-Package Purchases

Each credit-package purchase is a separate, one-time transaction that you authorise at checkout. These Terms do not provide for automatic credit top-ups. We do not charge automatically for a new credit package merely because your credit balance is low.

5.3 Payment Processor and Taxes

Waffo Pancake processes payments through its hosted checkout and consumer portal. We do not intend to store full payment-card details on our servers. Unless stated otherwise at checkout, displayed prices exclude applicable taxes, which may be collected where required by law.

6. Cancellation

You may cancel a subscription at any time through your account's Billing or Subscription settings, through the Waffo Pancake consumer portal made available to you, or by contacting support@seedance3.lol from your account email. Cancellation stops the next renewal and takes effect at the end of the current paid billing period; you retain subscription access for the remainder of that period.

Cancellation does not cancel or accelerate the expiration of separately purchased credits. They remain usable until their original expiration date, subject to these Terms. Subscription credits remain subject to their stated 30-day expiry. Ending a subscription does not entitle you to a refund except as provided in section 7 or by applicable law.

7. Refund Policy

7.1 Subscription Refunds

Because our digital services are intangible and delivered immediately, subscription fees are generally non-refundable, except as set out below or where mandatory law provides otherwise.

Only a first-time subscriber may request a full refund within seven calendar days after the first subscription charge if no more than 5% of the credit allocation for that subscription plan has been used. Renewal charges and subscribers who have previously held a paid subscription are not eligible for this first-time-subscriber guarantee.

7.2 Credit-Package Refunds

You may request a full refund for a separately purchased credit package within seven calendar days after purchase only if no credits from that package have been used. Once any credits from the package have been used, no refund is available for that package, including for its remaining unused credits.

7.3 Subscription-Credit Rollover

Subscription credits do not roll over. Each subscription-credit allocation expires 30 days after issuance, including if the subscription billing period has not otherwise ended.

7.4 Purchased Credits After Cancellation

Cancellation of a subscription does not affect separately purchased credits. They remain available until their original expiration date, subject to these Terms.

7.5 Credit-Consumption Order

Credits are consumed from the available, unexpired credit grants with the earliest expiration date first. Where expiration dates are the same, credits are consumed in issuance order.

7.6 How to Request a Refund

Send refund requests to support@seedance3.lol with your account email, order or transaction ID, purchase date, and reason for the request. Approved refunds are returned to the original payment method within 5–10 business days. Mandatory law controls where it applies.

8. Billing Disputes

If you believe a charge is incorrect, contact support@seedance3.lol before opening a payment dispute. Include your account email and transaction ID. We will aim to acknowledge billing enquiries within two business days and correct verified billing errors within five business days where reasonably practicable. This does not limit any non-waivable rights you have under applicable law.

9. Your Content, Outputs, and Intellectual Property

Inputs are prompts, reference images, and other material you submit. Outputs are images, videos, and other material generated for you through the Service.

As between you and us, and subject to applicable law and third-party provider terms, you retain rights in your Inputs and we assign to you any rights we may have in Outputs generated from your Inputs. You may use Outputs for lawful purposes, including commercial purposes, provided that you comply with these Terms and obtain any required permissions.

You grant us a limited, non-exclusive, worldwide licence to host, process, transmit, and use Inputs and Outputs only as necessary to provide, maintain, secure, and comply with legal obligations relating to the Service. Unless you explicitly permit it or applicable law requires otherwise, we do not use your Inputs or Outputs to train, fine-tune, or improve AI models, and we do not sell your content.

You represent and warrant that you have all rights, permissions, notices, and consents necessary for your Inputs and intended use of Outputs. We and our licensors retain all rights in the Service, software, interface, and branding not expressly granted to you.

10. Acceptable Use

Your use of the Service is also subject to our Acceptable Use Policy, which provides additional content, safety, reporting, and enforcement rules.

You must not use the Service to create, upload, request, distribute, or assist with content or conduct that:

• Violates applicable law or regulation;
• Infringes intellectual-property, privacy, publicity, or other third-party rights;
• Exploits or sexualises minors, or creates non-consensual intimate imagery;
• Impersonates a person, facilitates fraud, or materially deceives others about a person's identity or the origin or authenticity of content;
• Is defamatory, harassing, or intended to cause unlawful harm;
• Creates malware, phishing material, cyberattack tools, or seeks unauthorised access to systems, accounts, or data;
• Bypasses safeguards or interferes with the security, availability, or operation of the Service or its underlying providers;
• Resells, sublicenses, shares, or provides unauthorised access to the Service; or
• Uses Service inputs, outputs, model responses, or derived data to train, fine-tune, benchmark, distil, or develop a competing AI or machine-learning model without our prior written permission.

We may refuse a generation, remove content, limit access, suspend an account, or take other action reasonably necessary to enforce this section or protect users, the Service, or third parties.

11. AI Limitations and Disclaimers

AI-generated material may be inaccurate, incomplete, unexpected, unavailable, or unsuitable for a particular purpose. Outputs may be similar to material created for other users and may be affected by third-party models. You must independently review Outputs and obtain appropriate professional advice before relying on them for legal, medical, financial, safety, or other high-impact decisions.

To the maximum extent permitted by law, the Service is provided as is and as available, without express or implied warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, uninterrupted availability, or error-free operation.

12. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or business opportunity arising from or related to the Service or these Terms.

To the maximum extent permitted by law, our total liability for all claims arising from or related to the Service or these Terms will not exceed the amount you paid us for the Service in the 12 months before the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded or limited under applicable law.

13. Suspension, Termination, and Deletion

These Terms continue while you use the Service. You may stop using the Service at any time. We may suspend or terminate access where reasonably necessary to address a breach of these Terms, fraud, security risk, legal obligation, or harm to users, the Service, or third parties.

You may request account deletion through your account settings. Termination does not affect charges already incurred, credit-expiration rules, or provisions that should survive by their nature, including payment, intellectual-property, acceptable-use, disclaimer, limitation-of-liability, and dispute provisions.

14. Changes and General Terms

We may update these Terms from time to time. For material changes, we will provide notice by posting the revised Terms, email, or another reasonable method at least 14 days before they take effect when required or reasonably practicable. Continued use after the effective date means acceptance of the revised Terms.

If any provision is unenforceable, the remaining provisions remain in effect. These Terms, the Acceptable Use Policy, the Privacy Policy, and the Refund Policy form the entire agreement between you and us concerning the Service, except for any separate written agreement signed by us.
